Driver involved in fatal Clemens Center Crash not facing charges
ELMIRA, N.Y. (WENY) -- The driver who hit an elderly couple outside of the Clemens Center in Elmira last November will not be charged.
The couple was crossing Clemens Center Parkway when they were hit on Nov. 20, shortly before 6 p.m.
Both of them were sent to the hospital with serious injuries, one of them later died. Elmira Police previously identified the victim as Judith Morse, an 80-year-old from Horseheads.
According to the Chemung County District Attorney's Office, the driver will not face charges because they could not stop in time and potentially did not see the couple.
Officials called it a tragic accident, saying the driver did not commit a crime in the crash and cooperated with the police investigation.
