SOUTHPORT, NY (WENY) -- There could be potential legal action ahead for the new owners of Cherry Lane Park in the town of Southport. 

The town's Code Enforcement office has issued a notice and order to cease and desist mobile home park operations, stating it is in violation of town code that requires a license for operation of a mobile home park.

The town voted to revoke the park's license to operate in August, when the property was still owned by Cherry Lane Park, LLC. In late September, the park's ownership was transferred to James Voorhees and Jeffrey Smith for $1, according to a Bargain and Sale deed filed in Chemung County. 

 The order issued to Voorhees and Smith directs them to immediately remove all occupants and mobile homes from the property, located at 1170 Sherman Avenue within ten days. The notice is dated October 11th; ten business days would be Friday, October 25th. The order states that operating a mobile home park without a license could result in a fine of $250, 15 days in jail or both. 

There are currently 11 trailers that remain in the park, all of which do not have running water, after service was terminated for non-payment in September. Several of the trailers are condemned, but others remain occupied by park residents or others. 

The trailers on the property are currently posted with notices from Code Enforcement and the Chemung County Health Department, stating they are not habitable.
