PAINTED POST, NY (WENY) -- New York State Police on Thursday provided some details about an assault on a woman on Tuesday at a home in the town of Erwin. 

John N. Marvin, II is charged with second degree murder, after initially being charged with second degree attempted murder, and first degree assault. 

As WENY News previously reported, troopers and deputies with the Steuben County Sheriff's Office responded to a 9-1-1 call for an assault at a home on Victory Highway in the town of Erwin. When authorities arrived, they found a woman with severe injuries. The victim was airlifted to Robert Packer Hospital in Sayre, where she passed away on Wednesday.

At Thursday's press conference, state police identified her as 60-year-old Heather L. Moran.

"The investigation revealed on February 20th, at approximately 3:45 p.m., Heather Moran arrived at the [home on Victory Highway] to assist her brother John M. Marvin II, with caring for their 81-year-old father. While the father and [Moran] were seated at the table, John Marvin II struck his sister in the head with a cast iron frying pan multiple times," said Capt. Kevin Sucher, for NYSP Troop E.

Police detailed that when their father stood up from his wheelchair to intervene, he fell to the ground, but was uninjured.

According to state police, Marvin II then called for help.

"John Marvin II called 9-1-1 and reported the incident. He was located at the residence, waiting outside for responding officers, and was taken into custody without further incident," said Capt. Sucher.

Marvin II is currently being held at the Steuben County jail without bail.

State police did not provide any details about what led up to the assault. They say Marvin has no prior criminal history.
