1/12/24 UPDATE: Waverly police now say 49-year-old Timothy Henry is now in the Tioga County jail, after being extradited back to New York from Pennsylvania.

Henry was arraigned in Waverly Village Court, where he was arraigned on charges of 2nd degree Assault, 2nd degree Reckless Endangerment, Endangering the Welfare of a Child, and misdemeanor Reckless Endangerment.

He pleaded not guilty, and was sent to the Tioga County Jail on $25,000 cash bail, awaiting further court action.


WAVERLY, NY (WENY) -- A Waverly man faces a number of charges after his infant child suffered an overdose due to exposure to fentanyl.

Waverly police say law enforcement and emergency responders were called to an apartment on Broad Street on October 13th, for a report of an eight month old child in severe respiratory distress. The baby was rushed to Robert Packer Hospital in Sayre, and then airlifted to Geisinger Medical Center in Danville for life-saving care. During the infant's treatment and investigation, authorities say they discovered the child had fentanyl in her system. The infant survived and recovered. 

Police obtained an arrest warrant for the child's father, Timothy Henry, 48, on charges of 2nd degree Assault, 2nd degree Reckless Endangerment, Endangering the Welfare of a Child, and misdemeanor Reckless Endangerment.

Authorities later tracked him down on December 19th, around 2:30PM in Sayre, Pennsylvania and arrested him. Henry is currently being held in the Bradford County Correctional Facility on $100,000 bail, and is awaiting extradition to New York state for further legal action.
