ELMIRA, NY (WENY) -- WENY News has an update on the court proceedings regarding the four men allegedly involved in the 2021 torture-murder case in Elmira. Thomas Bovaird, Eddie Marte, Kavon Sanders, and Malik Weems are all accused of torturing and killing Juan Jose Gotay in January 2021.

According to authorities, the men beat, mutilated, burned, and bound Gotay with an electrical cord before dumping him in a remote area of Pennsylvania, where he was later found dead.

Two of the four men appeared in court on December 8th; Marte and Weems.

According to the County Court, Weems' sentencing is on January 19th. Weems pleaded guilty to second-degree murder in May 2023. Marte will appear in court again on December 15th, where there will be additional Wade Hearings and Huntley Hearings.

Wade and Huntley hearings are special court meetings that happens before the trial. During the Wade Hearing, the accused can argue the way they were identified by witnesses was not fair or legal. Huntley Hearings are used to determine whether the court will prohibit the prosecution from using statements made by the accused at the time of the arrest against them at trial.

A third suspect in the case, Thomas Bovaird pleaded guilty to second-degree murder in June 2023. Bovaird is scheduled to appear in court on January 12th, 2024.

The fourth subject, who was a minor at the time was identified as Kavon Sanders. Sanders was convicted of first-degree manslaughter at a non-jury trial in October 2023. Sanders is scheduled to be sentenced on January 19th, 2024.
