Former Tompkins County Sheriff's Deputy Arrested on Sexual Misconduct Charges
ITHACA, N.Y. (WENY) -- New York State Police arrested a former Tompkins County Sheriff's Deputy, who is accused of on-duty sexual misconduct when they were employed by a different law enforcement agency in Livingston County, N.Y.
According to the Tompkins County Sheriff's Office, former Deputy Kristofor O'Rourke, 29, was let go from his position on November 21st. According to Sheriff Derek Osborne, O'Rourke was placed on administrative leave after a woman filed a complaint on November 9th against O'Rourke, accusing him of "inappropriate sexual verbal communication" while O'Rourke was on-duty. The Sheriff's Office says the complaint was made to a law enforcement agency in Cortland County. After the complaint was investigated, O'Rourke was later terminated.
The following day after O'Rourke was let go from the Tompkins County Sheriff's Office, the Sheriff's Office said it was notified of a separate investigation into O'Rourke -- and O'Rourke was arrested on the 28th by New York State Police. He is charged with Criminal Sex Act in the 3rd Degree and Official Misconduct.
According to the Livingston County District Attorney during a Monday press conference, O'Rouke, who was previously employed as a police officer in Geneseo, pulled over and arrested a woman for DWI in July. He is accused of engaging in oral sex without the woman's consent after she was arrested -- and while he was on-duty and in uniform.
Officials say O'Rourke, was also previously employed by the Watkins Glen and Mount Morris Police Departments. Officials added that there may be more victims in connection to O'Rourke.
In a press release, the Tompkins County Sheriff's Office said the District Attorney determined that the complaint made to the Cortland County law enforcement agency did not "rise to the level of a criminal charge", however, the Sheriff's Office will now review other cases involving O'Rourke during his time with TCSO.
The Tompkins County Sheriff's Office said O'Rourke was hired in August as a lateral transfer from the Geneseo Police Department. TCSO said no disciplinary or performance concerns came up during the background checks. Sheriff Osborne said despite the thorough background check into O'Rourke, he wanted to apologize to the community, for "having one slip the through the cracks and potentially put people in our community at risk."
O'Rourke is currently behind bars at the Livingston County Jail. Anyone who may have had inappropriate contact with O'Rourke is urged to call New York State Police at (585)-398-4100.
