ELMIRA HEIGHTS, N.Y. (WENY)--State police investigators have located the car and driver they say was involved in the alleged fatal hit and run on Friday in Elmira Heights.  

"I don't want to hold that anger for the rest of my life. It was a really bad decision that they left the scene of the crime but I can't really pass any judgment on it. I don't know the situation. Like I'm mad that they hit him and left, that I'll be angry about. But right now I'm just choosing to not pass judgment cause it just weighs you down, Carrie Conte, sister of Jon Gearheart.

State police have identified 44-year-old Jon Gearhart as the victim who was killed on Friday, November 11th in a hit and run. 

According to state police, the Chemung County District Attorney is being consulted regarding possible charges while the investigation is still ongoing. 

Police say Gearhart was traveling on State Route 14 when he pulled over and got out of the car to move a dear carcass in the road just after 5 pm when he was struck by a vehicle that did not stop.  Despite life-saving efforts at the scene, Gearhart was later pronounced dead.

Conte says she found out about her brother's death through social media. She was heartbroken and explains Gearhart was kind, caring, and had a big heart. He would help anyone.

"They were coming around the corner on the miracle mile and Gearheart saw that there was a deer in the road, he wanted to make sure that nobody else hit it, somebody already hit it, it was in the middle of the left lane. He pulled over and got out of the car to move it so no other motorist got hurt and the guy hit him," Conte said.

She has received many negative comments regarding the way her brother died and would like the negativity to end.

He was a positive person and she would like him to be remembered as someone who was kind and had a big heart and not as quote "road kill."
