Police: Man killed by property 'caretaker' in Nichols

NICHOLS, N.Y. (WENY) -- A Bradford County man was killed over the weekend during an armed altercation at a home in Nichols, New York.
According to the Tioga County Sheriff's Office, deputies responded to a report of a shooting in the Town of Nichols near the intersection of Lynch Rd. Once on scene, Sheriff's deputies, along with State troopers, found a man in the roadway with a gunshot to his upper abdomen.
The man was later identified as 29-year-old Cody Wagner, of Rome, PA. He was pronounced dead at the scene.
The Tioga County Sheriff's Office Criminal Investigation Division determined Wagner had unlawfully entered a house located at 1958 Waite Road in Nichols.
Wagner was then reportedly confronted by, according to the Sheriff's Office, the caretaker of the property who was armed with a shotgun. Authorities say the caretaker attempted to take Wagner to a nearby residence to call 911.
Before the two were able to get to a location to have the ability to call 911, police say Wagner was able to get a revolver out of the car he had driven and pointed it at the caretaker. The caretaker then fired the shotgun once, striking Wagner in the upper abdomen. The caretaker then immediately went to a location where he was able to call 911.
The Tioga County Sheriff’s Office was assisted by the New York State Police Bureau of Criminal Investigation, Nichols Fire Department, Greater Valley EMS, and Tioga County District Attorney Kirk Martin.
The investigation remains ongoing. There are no charges against the shooter at this time.
